Rohit A. Sabnis

Rohit Sabnis is a partner in Burnham Brown’s Oakland office where he focuses his legal practice on civil litigation.  Mr. Sabnis has broad based experience in a variety of areas including environmental matters, products liability, commercial disputes and ADA litigation.  He has successfully handled complex matters involving single and multiple plaintiffs, coordinated proceedings and class actions.  Mr. Sabnis has served as lead trial counsel for a wide variety of clients from small privately held companies to national corporations and government agencies. 

Prior to joining Burnham Brown, Mr. Sabnis was an Assistant Hennepin County Attorney (Minneapolis).   

Practice Experience

  • Defense of numerous product manufacturers, distributors, retailers, premise owners in personal injury claims involving occupational and environmental exposure to various chemical products including asbestos, benzene, carbon monoxide, diacetyl, formaldehyde, industrial solvents/cleaners, pesticides and talc.
  • Defense of government enforcement and administrative actions including those brought by the California Environmental Protection Agency, District Attorneys and the California Attorney General.
  • Defense of various entities in California Proposition 65 enforcement actions involving the alleged failure to provide warnings for numerous listed chemicals including acrylamide, ethanol in alcoholic beverages, phthalates and BPA.
  • Defense of property owners and operators in private and government environmental clean-up actions.
  • Defense and prosecution of various commercial matters including antitrust, breach of contract, unfair competition laws, including California Business and Professions Code section 17200, trade secret disputes and insurance litigation.
  • Defense of alleged violations of the Americans with Disabilities Act (ADA) and similar state statutes, including website accessibility claims. 
  • Defense of product liability matters involving personal injury and property damage. 

Litigation

  • Experienced in all aspects of civil litigation in state and federal trial and appellate courts and before administrative agencies.
  • Obtained successful resolution of matters through summary judgment, trial and tenders of defense.

Advice & Counsel

  • Regularly provides advice and counsel to clients on compliance issues involving state and federal regulations including California’s Proposition 65 warning requirements.
  • Works with clients to mitigate liability risks and litigation costs.

Successes

  • August 2020: Summary judgment granted in favor of national retail client as to all claims in ADA matter involving alleged non-compliant transaction counter.
  • August 2020: Favorable resolution of California agency enforcement action involving alleged violations of environmental pesticide regulations.
  • July 2020: Favorable resolution of Proposition 65 matter involving alleged presence of acrylamide in food products.
