Burnham Brown Obtains Win for SJSU Police Officers Sued For Excessive Force Under Section 1983 – Case Dismissed Based on Qualified Immunity

              

               On March 10, 2016,  Burnham Brown attorneys John Verber and Aimee Hamoy-Perera, representing two San Jose State University police officers, obtained a grant of summary judgment based on qualified immunity.  The two officers were alleged to have used excessive force in violation of federal and state law when they shot and killed a knife-wielding suspect in February 2014.  The shooting incident was captured via  body-worn camera and provided the critical evidence to convince Judge Koh to dismiss the case.  Judge Koh’s ruling and order can be found here
