Dean Pollack

Dean Pollack is a partner in Burnham Brown’s Oakland office and is a member of the firm’s Real Estate, Environmental and Litigation practice groups. Mr. Pollack successfully tries, mediates and arbitrates real estate, commercial, product and general liability litigation cases on behalf of businesses and individuals. He has done so in California for 25 years.

Practice Experience

  • Trial lawyer whose practice focuses on real estate, commercial disputes, product and premises liability, and grave bodily injury claims in state and federal cour.
  • Local trial counsel defending service providers, construction sub-contractors and manufacturers in numerous arbitrations and mediations for personal injury claims including products, auto and premises liability, train collisions, roll-overs, explosions, and complex litigation involving exposure to mold, formaldehyde, various organic compounds and asbestos.
  • Defends and prosecutes unlawful detainer and forcible detainer actions, habitability claims, and discrimination cases.
  • Retained by private and public entity property owners to defend, and take offensive measures, establishing and enforcing easements and adverse possession of property, and solve liability exposures relating to residential and commercial properties.
  • State court litigation involving defense of unfair business claims, interference with contractual relations, breach of fiduciary duty.
  • Managed dedicated team of 15 including attorneys, paralegals, investigators and experts in multi-million dollar traumatic brain injury case for transportation provider in road rage case.

Litigation

  • Civil trial experience to verdict/judgment.
  • First chair experience in binding multi-day arbitration which resulted in favorable easements and property rights for our client.
  • Authored Successful Appellate argument regarding due process and dispositive motions.
  • Prevailed on dispositive motions in products liability and contract cases including demurrers, motions for summary judgment, summary adjudication, and motions to strike involving strict liability, negligence, punitive damages, intentional interference with contract and prospective economic advantage and pre-emption.

Advice & Counsel

  • Substantial experience in counseling property owners on transactional and liability issues, and advising insurers and their insureds on litigating toxic tort claims.
