Katrina R. Durek is based in Portland, Oregon. Her practice spans the Pacific Northwest, as she is licensed in Oregon, California, and Washington. Katrina’s expertise includes business and commercial litigation, employment, and general liability. Litigation

  • Experienced in all aspects of civil litigation in state and federal trial and appellate courts and before administrative agencies.
  • Litigates class action and single plaintiff cases throughout the State of California, including developing discovery plans to defeat class certification and prevail on dispositive motions to posture cases for early and effective resolution.
  • Obtains successful resolution of matters through summary judgment, trial and tenders of defense.
  • Initiates alternative dispute resolution proceedings, including mediation, voluntary settlement conferences, and early neutral evaluation.

  • Counsels and represents businesses of varying sizes, including large and mid-size restaurant franchises, small businesses, and transportation companies in contract disputes, employment and civil litigation matters.

Successes

  • October 2019: Obtained summary judgment for large national retailer in premises liability matter. Plaintiff alleged she slipped and fell on liquid at the retailer’s store. Summary judgment was granted on the basis there was no notice of the dangerous condition.
  • September 2019: Obtained judgment through motion for nonsuit for a multi-national retailer at jury trial in premises liability/workers’ compensation case. Plaintiff, an employee, claimed he suffered injuries from a chemical exposure when he was cleaning the store that was recently cleaned with bleach. Plaintiff argued his case was an exception to the workers’ compensation exclusionary rule. The judge found there was no evidence to support Plaintiff’s causes of action, and granted the retailer’s motion for nonsuit.
  • June 2018: Obtained defense verdict at jury trial for large multi-national retailer in premises liability matter. Plaintiff alleged she sustained a TBI from slipping on coffee spilled by another customer. The jury found no liability as to the retailer.
  • November 2017: Obtained defense verdict for large national retailer at jury trial as in premises liability/lost business case. Plaintiff alleged he lost his pizza parlor in a fire that originated at the retailer’s store. The fire was an arson. The jury unanimously found no liability.
  • July 2015: Obtained summary judgment for large-scale property owner in premises liability matter. Plaintiff alleged injuries from a slip-and-fall at an apartment unit. Summary Judgment was granted on the basis that there was no notice of a defect.
