Mark Heisey

Prior to becoming a civil litigator, Mark served a 2 year tour of duty with the United States Peace Corps in the Dominican Republic as a Community Environmental Development and Education specialist.  After graduating with highest honors from Golden Gate University School of Law, Mark worked as a litigator in house for an insurer, trying several cases as a first chair trial attorney in his time there.  Mark currently works as a contract attorney at Burnham Brown, specializing in complex motion drafting and trial advocacy.

Practice Experience

  • General Civil litigation practice with an emphasis in the areas of premises liability, personal injury, retail and hospitality.
  • Evaluates risk and exposure of claims and recommends litigation strategies to corporate clients.
  • Represents parties in all phases of litigation, including discovery, law and motion, mediation, and trial.

Litigation

  • First Chair trial experience in three cases prior to joining Burnham Brown.
  • Second chair trial experience in personal injury habitability.

Advice & Counsel

  • Interview and develop legal strategy for clients seeking dismissals or resolutions of criminal conviction.

Successes

  • Febrary 2020: Landlord/tenant and premises liability/breach of warranty of habitability lawsuit in which the plaintiff’s demand for most of the lawsuit was $2.5 million. The trial was interrupted on March 17, 2020 due to Covid-19 restrictions, and resumed on June 25th.  After deliberating for a day and a half, the jury returned a verdict awarding plaintiff only $93,290 in damages and found for defendants on Plaintiff’s causes of action for Intentional Infliction of Emotional Distress, Concealment, and punitive damages.
